Articles of Constitution

ARTICLE I
New Brunswick Teachers' Association - Branch No. 1450
Name: This Association shall be known as New Brunswick Teachers' Association Branch 1450

ARTICLE II
Objectives: The objectives of the Association shall be:

  1. To encourage teachers in their self improvement through Professional Development, in-service training, Subject Councils, and others.
  2. To promote professionalism among its members.

ARTICLE III
Membership (Regular): the membership of the Association is open to:

  • All teaching personnel who are duly registered with the New Brunswick Teachers' Association.
Membership (Casual - Certified):
  • All certified supply teachers who are duly registered as casual members of the New Brunswick Teachers' Association
Honorary Membership:
  • Student Interns that are doing a practicum with a regular member of branch 1450. They may not hold office or vote.

ARTICLE IV
Executive Committee: The Executive Committee shall be composed of:

  3. Vice- President
  4. Secretary
  5. Treasurer
  6. Director
  7. Professional Development Chairperson
  8. Past-President who shall act as “ex-officio” to the Executive.
  9. Alternate Director
Each person on the Executive Committee shall have one vote.

ARTICLE V
Election: The election of officers shall be carried out in accordance with Robert's Rules of Order:

  • The Nominating Committee shall be appointed by the President, 4 weeks, and prior to the Local AGM.
  • A Nominating Committee shall submit a list of candidates for the coming term of office. The Nominating Committee shall nominate only one person for each position.
  • The nominations shall be accepted from the floor at the Local Annual General Meeting (AGM).
  • All the executive positions will be decided at the AGM meeting.

ARTICLE VI
General Meeting: The Annual Meeting will be held in May at a date to be determined by the Executive Committee.

ARTICLE VII
Voting Procedure:

  • All votes may be signified by a “yea” or “nay” at regular meeting or by a rising of hands.
  • A secret ballot vote may be requested by the majority of the members in attendance at any meeting. (50% +1)
  • All voting for elected office shall be done by secret ballot.
  • To be elected to office, 50% plus 1 of the votes would be needed.

ARTICLE VIII
Term of Office: The President and the Secretary shall be elected for a two-year term commencing July 1 of the elected year.

The Director & Alternate Directorshall be elected for a three-year term. The term begins at the Post-AGM. They cannot serve for more than 2 consecutive terms.

The Professional Learning Chairperson shall be elected for three-year term commencing July 1. At the conclusion of the term of office, the position shall be filled.

The Treasurer shall be elected for a two-year term.

The Vice-president shall be elected for two year term.

Should any officer (other than the President) not be able to complete their term, an ‘acting officer' should be voted in at the next general meeting. Said officer shall remain in place until the next AGM.

ARTICLE IX
Duties of Officers:

President:

  • Shall send notice to call a meeting
  • Shall preside at all meetings.
  • Shall fulfill his/her duties as specified in Robert's Rules of Order
  • In case of a tie vote, he/she shall cast the deciding vote ballot.
  • Shall maintain a certain decorum, order and discipline in all business procedures during his/her meeting.
  • At the completion of the approved agenda, he/she shall entertain a motion for adjournment.
Vice-President:
  • Shall replace the President with all his/her power when the latter is absent.
  • Shall replace the President if the latter resigns, dies, or moves away.
  • Shall call for a by-election to fill the vacant position of Vice-President if he/she is elevated to the Presidency.
The Secretary:
  • Shall be responsible for the safe-keeping of all records of the Association (Branch)
  • Shall keep all correspondence and acknowledge his/her reception and association decision, if necessary.
  • Shall send all year end reports to the NBTA.
Treasurer:
  • Shall keep an accurate and detailed account of all monies (PD account, & Admin account), receipts and disbursements.
  • Shall prepare and present an accurate financial report at all meetings.
  • Shall pay all bills authorized by the membership.
  • Shall submit a year- end financial report to the NBTA.
Executive Committee:
  • Shall be responsible for the preparation of the agenda for any meeting.
  • Shall authorized payment of bills.
  • Shall carry out the wishes of the majority members as recorded in the minutes.
  • Must ensure the proper conduct of the Association business during all meetings.

ARTICLE X
Meeting:

  • The Executive Committee shall meet as required excluding the special and regular meetings.
  • The Association shall hold a minimum of 3 regular meetings, annually.
  • One-third of the regular membership may request a special meeting for any valid reasons.
  • The President shall call special meetings, if necessary.

ARTICLE XI
Quorum:
1. Executive Committee - Half of the executive members with voting power will form a quorum.

2. Regular Meeting - The minimum of regular members in attendance to form a quorum is one - third of the members plus one.

ARTICLE XII
Remuneration: All financial expenses incurred as a result of NBTF/A business by any member of the Association must be submitted to the Executive for approval in order to receive payment.

ARTICLE XIII
Auditing: All financial records will be audited yearly by a member(s) who are not members of the Executive Committee. They shall submit a written report.

ARTICLE XIV
Committees:
1. Standing Committees - As recommended by the New Brunswick Teachers' Association.
2. Special Committees - As appointed by the Executive Committee of the Branch Association.

ARTICLE XV
Amendment: The constitution can be amended only at the annual meeting; additional Articles may be added at any general meeting; upon the approval of 75% of the membership.
