Articles of Constitution

ARTICLE I - Name

This organization shall be known as Branch No. 0215 of the New Brunswick Teachers Association (N.B.T.A.)

ARTICLE II - Definitions

"Association" shall mean the New Brunswick Teachers' Association

"Member" shall mean any teacher as defined by the Act of Incorporation of the NBTA By-Laws, excepting active members of the Association des Enseignantes et des Enseignantes Francophones du Nouveau-Brunswick (AEFNB), shall be eligible for membership in the NBTA Branch in his/her district.

"Branch" shall mean the body of members duly constituted by the Association.

"Executive" shall mean the Executive Committee of the Branch.

Article III - Authority and Responsibility

The Branch may take any measure not inconsistent with the provisions of this Constitution, the NBTA Act of Incorporation and the By-Laws or any Act or Regulation of the Province of New Brunswick which it deems necessary in order to give effect to any policy adopted by it with respect of any question or matter directly or indirectly relating to the teaching profession.

ARTICLE IV - Aims and Objectives

Section I To promote the cause of education in School District 2, or its successor.
Section IITo make what contribution we can toward raising the status of our profession.
Section IIITo protect our economic security.
Section IVTo provide a means of united consideration of the larger issues which may arise in the Provincial Organization.

Article III - Membership

Section I Membership in the Branch shall be as defined in Article II.
Section II (a) Associate membership may be conferred by the Branch Representative Council or at a Branch Annual General Meeting, upon such persons employed by School District 2, or its successor, who have qualified to become members of the NBTA.
(b) Associate members shall enjoy full membership rights except they shall not be eligible to vote or to hold any Branch office.

ARTICLE IV - Meetings

Section I A minimum of three Representative meetings per year shall be held including a meeting prior to the Provincial N.B.T.A. Annual General Meeting.
Section IIThe Branch shall hold an Annual General Meeting prior to the Provincial NBTA Annual General Meeting.
Section IIIOther meetings of the Representative Council shall be called at the discretion of the President.

ARTICLE V - Executive Officers

Section I The Executive officers of Branch No. 0215 of the N.B.T.A. shall consist of the following officers: The President, First Vice-President, Second Vice-President, Secretary, Treasurer, Past President, two Branch Directors, and two Alternate Directors.
Section II (a) The term of office of the President and Vice-Presidents shall be two years.
(b) The term of office of the Secretary and Treasurer shall be three years.
(c) The Branch Directors and Alternate Directors shall be elected for a term of three years.
(d) No Executive officer may serve more than two consecutive terms in the same office.
(e) The term of the Executive shall begin with the new school year.
Section II The President or his/her delegate shall (1) preside at all meetings; (2) be an ex-officio member of all committees; (3) attend all Liaison Meetings.
Section IIIThe First Vice-President shall; 1) be responsible for Resolutions and Terms and Conditions and (2) in the absence or disability of the President, perform the duties of the office.
Section IVThe Second Vice-President shall; 1) in the absence or disability of the President and First Vice-President perform the duties of the office, (2) be responsible for the Awards Committee.
Section V The Secretary shall (1) keep a careful record of the proceedings of all meetings and properly attend to the correspondence of the Branch, (2) see that members of the Representative Council receive notification of time, place and agenda of Branch Meetings at least one week in advance whenever possible.
Section VI (a) The Treasurer shall; 1) keep the accounts of the Branch, 2) pay all bills authorized by the Representative Council or the Executive, 3) prepare a budget for the following year to be approved by the membership at the Branch Annual General Meeting.
(b) The books shall be duly verified and a report shall be presented at the Branch AGM.
Section VIIThe Past President shall be responsible for the Retiring Teachers' Banquet and perform, with the Nominating Committee or designate, the duties of an election.

ARTICLE VIII - Duties of Officers

Section I The President or his/her delegate shall (1) preside at all meetings; (2) be an ex-officio member of all committees; (3) attend all Liaison Meetings.
Section II The First Vice-President shall; 1) be responsible for Resolutions and Terms and Conditions and (2) in the absence or disability of the President, perform the duties of the office.
Section III The Second Vice-President shall; 1) in the absence or disability of the President and First Vice-President perform the duties of the office, (2) be a member of the Health and Safety Committee, (3) chair of the Awards Committee.
Section IV The Secretary shall (1) keep a careful record of the proceedings of all meetings and properly attend to the correspondence of the Branch, (2) see that members of the Representative Council receive notification of time, place and agenda at least one week in advance whenever possible.
Section V 1. The 1. The Treasurer shall; 1) keep the accounts of this organization, 2) pay all bills authorized by the Representative Council or the Executive except as noted in subsection 2.
2. The books shall be duly verified and a report shall be presented at the September meeting of the Branch.
Section VI The Past President shall chair the Nominating Committee and perform, with the Nominating Committee, or the Executive Committee designate, the duties of an election.

ARTICLE VI - Representative Council

Section I The Representative Council shall consist of: The President, First Vice-President, Second Vice-President, Secretary, Treasurer, Branch Directors, Alternate Directors, Past President, Chair of all Committees, one representative of each school, one representative for itinerant or non-school based teachers and one representative for Supply teachers for District 02, or its successor, who are enrolled with N.B.T.A..
Section IITo the Representative Council are entrusted the welfare and the progress of the Branch and it shall be the duty of the Representative Council to work with these objectives in view.
Section IIIThe Representative Council shall hold such meetings of their group as will enable them efficiently to carry on all work for which they have assumed responsibility in connection with the Branch.
Section IVThe Representative Council shall be empowered to spend Branch funds on behalf of the Branch membership.
Section VA quorum shall be achieved with 50% of the possible members of the Representative Council present.

ARTICLE VII - Elections

Section I (a) The election of the Executive shall be held during the Branch Annual General Meeting.
(b) Elections for Directors shall be held under the direction of the Branch President as required before the Provincial NBTA Annual General Meeting in any year with the Alternate Directors being elected at the same time.
(c) The school representative shall be elected by his/her respective staff or selected in a manner appropriate to each school by September 1st. At the same time an alternate representative shall be selected.

ARTICLE VIII - Voting

Section IAt the Branch Annual General Meeting each member present shall be entitled to one vote.
Section IIAt Representative Council meetings, unless called for otherwise, each member of the representative council, as defined in Article VI Section I, shall be entitled to one vote.
Section IIIIn the event of a tie during voting, the Branch President may cast the determining vote.

ARTICLE IX - Duties of NBTA School Representative

Section IThe school representatives shall:
  1. Attend all Branch Meetings or have an alternate attend.
  2. Report to their school any business undertaken at the Branch Meeting.
  3. Bring to the meeting any school concerns.
  4. Create interest in the N.B.T.A. at the school level.
  5. Provide the members of their staff with any information on N.B.T.A. that they may require (i.e., heads of local and provincial committees).
  6. Report to the Treasurer of the Branch any deaths of teachers and/or of teachers' families.
  7. Receive nominations and distribute and receive ballots for the election of Branch Officers.
  8. Pick up communiquŽs during negotiations.
  9. Represent their respective staffs on matters requiring a vote.

ARTICLE X - Committees

Section I Branch committees will be formed to serve the following purposes:
  1. To carry out policies established in the branch constitution.
  2. To represent the branch membership in matters of interest or concern to teachers.
  3. To serve as special study or advisory groups as directed by the membership.
Section II The operating terms of reference of Branch committees shall be defined according to these guidelines:
  1. Authority - The terms of reference for each committee shall recognize the advisory status of the committee structure. The authority to establish or change branch policies rests solely with the membership of the branch or the decision making bodies provided specifically in the Constitution.
  2. Responsibility - Teachers who accept the positions of committee members shall perform the committee tasks in an ethical and professional manner.
Section III Terms of Reference
  1. To complement the established committees at the provincial level and to deal with perceived local needs.
  2. Appointment of committee members
    1. Any teacher wishing to serve on a committee must submit his/her name to the Nominating Committee by the same deadline as stated in the Constitution for Executive nominations. It will not be necessary for elections to be held. The President will appoint the Chair of each committee.
    2. Each Chair will select his/her own committee with due consideration to represent all levels, if possible.
    3. Each committee should have at least four members, including the Chair.
    4. Should it be necessary for new members to be appointed during the term of office of the committee, the Chair shall make the appointments.
    5. The term of office for every committee, including the Chair, shall be for a maximum of four years, with half the membership retiring every two years.
  3. Filing of reports
    1. Every active committee must submit a yearly report.
    2. Any committee may submit a report, as required or requested, at a meeting of the Branch Representative Council.
    3. Each committee should maintain a written report of any meetings held (Minutes), including the names of members present and the nature of the business excepting the Ethics Committee who will report but leave out names.
  4. Budget responsibilities
    1. Each committee shall submit a detailed budget request to the Executive as the need arises.
    2. Each committee shall be accountable to the Representative Council for all expenditures.
    3. No committee shall attempt to raise funds other than monies requested from the Representative Council or maintain a bank account solely apart from the monitoring of funds through the Treasurer of the Branch without the express approval of the Representative Council.
Section IV (a) There shall be the following Committees:
  1. Resolutions
  2. Professional Learning
  3. Ethics
  4. Nominating
  5. Liaison
  6. Awards
  7. Retiring Teachers' Banquet
(b) Other committees may be appointed as deemed necessary by the Representative Council.

Article XI - Delegates to the A.G.M.

Section I Voting Delegates to the Provincial Annual General Meeting of the N.B.T.A. shall be: President or President Elect and Secretary or Secretary Elect. The remainder of the voting delegates shall be elected from the membership.

Article XII - Printing and Distribution

Section I The Constitution of Branch 0215 shall be posted on the N.B.T.A. Website.
Section II The Constitution shall be reviewed at the first Executive meeting of each school year.

Article XIII - Amendments

The Articles of the Constitution of this Branch may be repealed or amended if supported by at least two-thirds of the members at a Branch Annual General Meeting provided that due notice of the motion has been given to the membership at least 30 days prior to the meeting. By-Laws of this Branch may be repealed or amended if supported by at least two-thirds of the members at a Representative Council Meeting provided that due notice of the motion has been given to the membership at least 30 days prior to the meeting.
