Articles of Constitution

(adopted May 1973, amended May 2000, May 2004)

ARTICLE 1: NAME OF BRANCH

    The name of the Branch shall be NBTA Branch 1610

ARTICLE 2: DEFINITION OF TERMS

    a) "Association" shall mean the New Brunswick Teachers' Association
    b) "Branch" shall mean that body of members duly constituted by the Association
    c) "Executive" shall mean the Executive Committee of the Branch
    d) "monthly meeting" shall refer to the meeting held every month by the Branch Executive Committee and the representatives from each school

ARTICLE 3: BRANCH AUTHORITY AND RESPONSIBILITY

    The Branch may take any measure (not inconsistent with the provisions of this Constitution, the NBTA Act of Incorporation or By-law or any Act of the Regulation of the Province of New Brunswick) which it deems necessary in order to give effect to any policy adopted by it with respect to any question or matter directly or indirectly relating to the teaching profession.

ARTICLE 4: OBJECTIVES

    The objectives of the Branch shall be:
    a) to act in co-operation with, to participate in and to support the Association in advancing the cause of education in the Province of New Brunswick
    b) with the Association, to raise the status of the teaching profession.
    c) through the Association, to impress the public with the importance of providing and maintaining progressive educational services
    d) to support the Association in promoting and safeguarding the interests of teachers and to provide advice to members in their professional duties and relationships.
    e) to advance the interests of education in the District and elsewhere, by maintaining close liaison between the Branch and the District
    f) to assist in the Professional Learning of its members

ARTICLE 5: MEMBERSHIP

    a) Any teacher, as defined in the Act of Incorporation or NBTA by-laws, excepting active members of the AEFNB, shall be a member in the Branch. If there is no NBTA branch in his/her district, he/she may join the NBTA branch of his/her choice.
    b) The District Superintendent, Director of Education, Supervisors and other professional educational staff may become members of the Branch if they become associate members of the NBTA.

ARTICLE 6: MEETINGS

    a) The Executive and school representatives shall hold at least one monthly meeting.
    b) All monthly meetings are open to all Branch members and may constitute a general meeting.
    c) The Annual Meeting shall be between April 1 and May 31 of each year, and officers shall be elected at this meeting. The term of office for officers shall be two years.
    d) A report of all meetings shall be forwarded to the Executive Director of the Association on forms provided, on or before June 15 of each year.
    e) Notice of meetings should be provided to each school in the Branch at least one weeks before the date for which the meeting was called.
    f) A special meeting must be called by the President at the written request of 25 members of the Branch.
    g) Business shall not be transacted unless a quorum be present. A quorum shall consist of 25 members.
    h) For voting purposes, only statutory members of the Branch listed on the most current Association Nominal Roll may vote.

ARTICLE 7: EXECUTIVE COMMITTEE

    a) The Executive Committee shall consist of the President, immediate Past-President, Vice-President, Secretary, Treasurer, Director and Alternate Director.
    b) The Executive Committee shall:
      1) meet at the call of the President
      2) direct and supervise the business, property and affairs of the Branch, between Branch meetings in conformity with policies and directives of the Branch as appearing from the minutes of the Branch.
      3) have such further powers and carry out other duties as may be assigned to it by the Branch from time to time.
      4) report to each Branch meeting on all actions and/or decisions taken or made by it since the last meeting
    c) A Branch meeting may, by a two-thirds majority vote of the members, rescind, revoke, annul or override any acts or decisions taken or made by the Executive Committee.
    d) All actions and decisions taken or made by the Executive Committee shall be effective and stand unless and until they are revoked, annulled or overruled by a Branch meeting as outlined in Article 7 (c) above.
    e) The Executive Committee shall be a member of the Joint Executive Committee of Branches within District 16, namely Branch 1608 (Newcastle) and Branch 1640 (Rexton).

ARTICLE 8: SCHOOL REPRESENTATIVES

    a) Each school shall choose/elect a Representative and an Alternate.
    b) Each Representative shall be required to attend all monthly meetings. If two consecutive meetings are missed the Alternate shall assume the role of Representative and a new Alternate shall be chosen.

ARTICLE 9: COMMITTEES AND/OR CHAIRPERSONS OF COMMITTEES

    a) Minimally, the following Committees or Committee Chairpersons shall be appointed by the Executive Committee or the President: Grievance, Liaison, Professional Learning, Professional Conduct and Standards, and Courtesy.
    b) All committees of the Branch are under the authority of are responsible to the Executive of the Branch.
    c) All guidelines of any committee must be approved by the Executive before they are instituted.
    d) Committee Chairs will inform the Branch President of the dates and times of committee meetings.
    e) The proposed budgets of all committees must be approved by the Executive.
    f) The use of Branch funds to purchase gifts for members, other than retiring teachers, shall require approval of the Executive.
    g) The Branch Courtesy Committee shall be solely responsible for cards, gifts, flowers, etc in case of illness etc. of members in accordance with guidelines established by the Executive.
    h) Committee Chairpersons may be requested to report to the monthly meeting.
    i) The president of the Branch shall automatically be a member of all Branch Committees.
    j) The President of the Branch shall be a member of the District Professional Learning Steering Committee, along with the Branch Professional Learning Committee Chairperson.
    k) The Branch President and Director shall be two of the members of the District Liaison Committee.

ARTICLE 10: AMENDMENTS

    The Article of the Constitution and/or By-laws of this Branch may be repealed or amended if supported by at least two-thirds of the members present at any regular or special meeting provided that due notice of the motion has been given to the membership at least 30 days prior to the meeting.

ARTICLE 11: BY-LAWS

    a) The Branch may pass by-laws (not inconsistent with the provisions of this Constitution, the NBTA Act of Incorporation or By-law or any Act of the Regulation of the Province of New Brunswick) by a two-thirds majority vote respecting:
      a) the election of the officers and Executive Committee of the Branch and their duties
      b) the election of a Director and members to serve on provincial committees of the Association
      c) the management of the property and affairs of the branch and its own internal organization and administration
      d) the levying and collecting of member ship and other fees
      e) the establishment of units of divisions of Branches, the definition of the areas within which they shall operate.
      f) matters that may be deemed necessary or convenient for the management of the Branch and the promotion of its welfare or conduct of its business
      g) branch delegates to the Association Annual General Meeting shall be the President and Vice-President of the Branch dependent upon the by-laws of the Association with regards to the number of delegates allowed by membership numbers. Alternate delegates shall be chosen by the Executive Committee in March, and shall be from the Executive or School Representatives, should the President and/or Vice-President be unable to attend the AGM.
