Articles of Constitution

Article I - Name
The name of the Branch shall be the NBTA Branch #1023.

Article II - Definition of Terms
(a) "Association" shall mean the New Brunswick Teachers' Association.
(b) "Member" - any teacher as defined in the Act of Incorporation or NBTA By-Laws, excepting active members of the Association des enseignantes et des enseignants francophones du Nouveau-Brunswick (AEFNB), shall be eligible for membership in the NBTA Branch in his/her district. If there is no NBTA Branch in his/her district, he/she may join the NBTA Branch of his/her choice.
(c) "Branch" shall mean that body of members duly constituted by the Association.
(d) "Executive" shall be the Executive Committee of the Branch.

Article III - Branch Authority and Responsibility
The Branch may take any measure not inconsistent with the provisions of this Constitution, the NBTA Act of Incorporation and By-Laws or any Act or Regulation of the Province of New Brunswick which it deems necessary in order to give effect to any policy adopted by it with respect of any question or matter directly or indirectly relating to the teaching profession.

Article IV - Objects
The objects of the Branch shall be:
(a) to act in co-operation with the Association in advancing the cause of education in the Province of New Brunswick;
(b) to raise the status of the teaching profession;
(c) through the Association, to impress the public with the supreme importance of providing and maintaining progressive educational services;
(d) to appeal to the Association to promote and safeguard the interests of teachers and to provide advice to members in their professional duties and relationships; and
(e) to establish close liaison regarding working conditions, teaching positions, appointment of principal, vice-principal, etc., and any problems that might arise between the Branch and the District Office or its administrators.

Article V - Membership
(a) Active membership shall be as defined by Article II(b).
(b) Associate, Honorary or Life memberships may be conferred as determined by the By-Laws of the Association.

Article VI - By-Laws
The Branch may pass By-Laws not inconsistent with the Constitution, the Act of Incorporation or By-Laws of the Association or any Act or Regulation of the Province of New Brunswick by a two-thirds majority vote respecting:
(a) the election of the Officers and Executive Committee of the Branch and their duties;
(b) the election of a Director to serve as Director for both the NBTA and the NBTF and an Alternate who will act in the absence or incapacity of the Director, and members to serve on provincial committees of the Association;
(c) the management of the property and affairs of the Branch and its own internal organization and administration;
(d) a fee of five dollars ($5.00) per annum be levied on the Branch 1023 membership for the school year 2001-2002, these funds to be used exclusively for covering the costs incurred for each retiree, and this issue to be reviewed annually at the General Meeting;
(e) the establishment of units or divisions of Branches, the definition of the areas within which they shall function and the government under which they shall operate;
(f) matters that may be deemed necessary or convenient for the management of the Branch and the promotion of its welfare or conduct of its business.

Article VII - Branch Meetings
(a) A Branch shall hold a minimum of three meetings a year. At least one meeting shall be held in the fall term, and at least one meeting shall be between January and April. An annual meeting shall be held between April 2 and May 31 each year at which the election or appointment of officers shall occur. Officers elected will assume their duties on the following September 1.
(b) Additional meetings or sub-meetings may be held as desired at the call of the Branch President.
(c) A report of all Branch meetings shall be forwarded to the Executive Director of the Association on forms provided on or before June 15 each year.
(d) A Branch Meeting may, by a two-thirds majority vote, rescind, revoke, annul, or overrule any acts or decisions taken or made by the Executive Committee.

Article VIII - Executive Officers
(a) Officers of the Branch shall consist of a President, Vice-President, Secretary, Treasurer, and Director;
(b) The officers are to be elected in a manner determined by By-Law;
(c) The Executive Committee shall consist of the elected Officers, the immediate Past President,the Director and any others named herein. All actions and decisions taken or made by the Executive shall be effective and stand unless or until they are revoked, annulled or overruled by a Branch Meeting;
(d) The Executive Committee shall:
(e) Meet at the call of the President;
(f) Direct and supervise the business, property and affairs of the Branch in conformity with the policies and directives of the Branch as they appear in the minutes of Branch meetings.

Article IX - Representative Council
(a) The Representative Council shall consist of the Executive officers, the chairpersons of essential committees and at least one representative of each school in the Branch.
(b) The Representative Council shall:

    (1) meet at the call of the President;
    (2) direct and supervise the business, property and affairs of the Branch between Branch Meetings in conformity with the policies and directives of the Branch as appearing from the minutes of the meetings of said Branch.
    (3) have such further powers and carry out such other dies as may be assigned to it by the Branch from time to time; and
    (4) report to each Branch meeting on all actions and decisions taken or made by it since the last meeting.
(a) The Representative Council shall meet at least once a month except July, August, and December.
(b) All actions and decisions taken or made by the Executive Committee shall be effective and stand unless and until they are revoked, annulled or overruled by a Branch meeting.

Article X - Committees
(a) The Branch shall strike at least those committees deemed essential by NBTA.
(b) Among any committees set up by a Branch shall be those which correspond to the provincial committees on which the Branch has representation.

Article XI - Amendments
The articles of the Constitution and/or By-Laws of this Branch may be repealed or amended if supported by at least two-thirds of the members at any regular or special meeting provided that due notice of the motion has been given to the membership at least 30 days prior to the meeting.
